The Hitfit franchisor, HITFIT AUSTRALIA PTY LTD (ACN 676 323 578), and each operator of a Hitfit gym is committed to respecting your privacy and this policy outlines our ongoing obligations to you in respect of how we collect, use, store and disclose your Personal information.

What is ‘personal information’?

Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable, regardless as to whether or not the information or opinion is true and whether or not the information or opinion is recorded in a material form. Examples of personal information we collect and hold include: names, addresses, contact information, bank and/or credit card details, height and weight and your image (including photographs and video footage).

Sensitive information is personal information about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual orientation or practices, criminal record, health information, genetic information, biometric information and biometric templates.  Other than health information collected for the purpose of your participation at Hitfit Gyms, we generally do not seek to obtain sensitive Information from you.  Where it is necessary for us to collect sensitive information from you, we will do so in accordance with the Privacy Act and this Policy.  If you voluntarily provide us with unsolicited personal information or sensitive information, you consent to us using this information in accordance with the Privacy Act and this Policy.

In certain circumstances, you may choose to interact with us anonymously or by using a pseudonym. However, in most cases, this will not be practical. If you do not provide the personal information we require, or if you provide it in a way that does not allow us to identify you, we may be unable to provide you with the services, assistance or information you have requested.

Acceptance of this Privacy Policy

By providing us with your personal information or by interacting with our social media sites (including actions such as posting, pinning, following, liking, commenting, or uploading any material) you consent to the collection, use, and disclosure of that information in accordance with this Privacy Policy.

If you do not agree to be bound by this Privacy Policy, you should not provide us with your personal information and refrain from interacting with our social media sites.

Collection of personal information

Personal information is obtained in many ways, including physical and online capture forms, our social media sites, customer service interactions, participation in competitions and promotions and otherwise interacting with us.

Personal information may also be provided to us by third parties such as health professionals or services providers engaged by us to conduct surveys, collect feedback, or perform related services on our behalf.

Your personal information may be shared between the Hitfit franchisor and Hitfit franchisees and other licensees.

Information can also be obtained by:

·            you choosing to automatically populate data fields on our website using information previously provided to a third party social media platform.  By doing so, you are authorising that platform to share certain information with us, including personal information, from your social media profile.

·            your web browser or mobile device may automatically provide to us personal information including your IP address, operating system name, browser name and version, the date and time of your visit, and the pages you access.  The personal information that we receive may vary depending on your browser or device settings.

·            cameras placed in and around our gyms for operational purposes, including security, safety monitoring, and fraud detection.

·            recording in our gyms for promotional purposes and other purposes disclosed in your membership terms.

·            the collection of information through cookies and similar technologies when you use our website.  A “cookie” is a small data file placed on your computer or device when you visit a website.  Cookies help the website recognise your browser on return visits and can enhance your experience – for example, by securely storing login details or remembering your preferences.  Like many commercial websites, we may use cookies and related technologies to:

o      collect information about your use of our website, such as the pages you visit, links you click, and time spent on each page;

o      supporting the functionality of our website by saving preferences;

o      personalise your experience; and

o      improve our marketing efforts, including through targeted advertising.

Why do we collect your personal information?

We may collect, hold, use and disclose your personal information for the following purposes:

•                to enable you to access and use the Hitfit franchisor’s, Hitfit franchisees’ and licensees’ services and websites;

•                to operate, protect, improve and optimise the Hitfit franchisor’s, Hitfit franchisees’ and licensees’ services and websites, their business and users’ experience, such as to perform analytics, conduct research and for advertising and marketing;

•                to send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you;

•                to send you marketing and promotional messages and other information that may be of interest to you, including information sent by, or on behalf of, the Hitfit franchisor, Hitfit franchisees and licensees and their business partners that we think you may find interesting;

•                to administer rewards, surveys, contests, or other promotional activities or events sponsored or managed by the Hitfit franchisor, Hitfit franchisees and licensees and their business partners;

•                with respect to recordings made in our gyms, in order to use that content for promotional purposes as disclosed in your membership terms

•                to comply with our legal obligations, resolve any disputes and enforce our agreements with third parties;

•                to consider your employment application;

•                to personalise your experience on our website;

•                for security, credit management, and fraud prevention; and

•                in order to publish any testimonials provided by you on our website[II1]  and/or social media pages.

We may also disclose your personal information to a trusted third party who also holds other information about you. This third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive.

If we are the operator of a Hitfit gym, we may disclose your personal information to the franchisor of the Hitfit network for the purpose of that company administering and supporting that network.

The Hitfit franchisor, Hitfit franchisees and licensees and their business partners may send you direct marketing communications and information about offered goods or services. This may take the form of emails, SMS, mail or other forms of communication, in accordance with the Spam Act and the Privacy Act. You may opt-out of receiving marketing materials by contacting the sender or by using the opt-out facilities provided (eg an unsubscribe link).

Disclosure of personal information

We may share personal information with third parties including:

·            the Hitfit franchisor, Hitfit franchisees and licensees;

·            our related bodies corporate;

·            third party suppliers and service providers (including providers for the operation of our websites and/or our business or in connection with providing our products and services to you);

·            payment systems operators (eg merchants receiving card payments);

·            our existing or potential agents, business partners or partners;

·            our sponsors or promoters of any competition that we conduct via our services;

·            anyone to whom our assets or businesses (or any part of them) are transferred;

·            third parties engaged for the purpose of enforcement or application of agreements with us;

·            contractors, agents and suppliers engaged to provide products and/or services;

·            our professional advisors, including legal and accounting experts;

We may publish material recorded in our gyms for promotional purposes and other purposes disclosed in your membership terms.

Security of personal information

We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your personal information. However, we cannot guarantee the security of your personal information. When your Personal information is no longer needed for any purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information. However, most personal information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your personal information

You may access the personal information we hold about you and update and/or correct it, subject to certain exceptions. If you wish to access your personal information, please contact us in writing.

In order to protect your personal information we may require identification from you before releasing the requested information.

Maintaining the Quality of your personal information

It is an important to us that your personal information is up to date. We will take reasonable steps to make sure that your personal information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Overseas Transfers

We are not likely to disclose your personal information to overseas recipients[II2] . In future it may be necessary or useful to disclose your personal information overseas. For example, this may be necessary in order to use an overseas supplier of ours. If required by the Australian Privacy Principles we will take reasonable steps to ensure that any overseas recipient will deal with such personal information in a way that is consistent with the Australian Privacy Principles. If you provide your consent to disclosure of your personal information to an overseas recipient, we may disclose your personal information overseas without taking such steps.
